What Happens When You Buy A Foreclosing Home?

I’ve been seeing a whole lot of postings on craigslist for a rent-to-own or “subject to” for a house going into foreclosure or behind on the mortgage. What happens when you buy a home going into foreclosure or “behind on the mortgage” (is that the same thing?) what happens with the house after you agree to rent the home? Thank you in advance!

We live in a home provided by my husband’s job, can we buy a home that is a primary residence in another town?

The home we would like to buy is 3 hours away. We will use the home for our frequent trips to that town, holidays, and eventual relocation. We also need to provide a safe and affordable place for my mother-in-law to live. We will pay the mortgage/maintance and she will cover the ultilities only.
We pay taxes on the fair rental value of the home my husband’s salary package includes, but we have no ownership in it nor do we own a home.
My Mom-in-law is 70, can no longer work at her former parttime job, is living on a fixed income, has RA, her meds for RA/ food/ basic needs per month cost more than her income, and the lot rent for her single wide manufactored home has tripled to over $600 per month in 6 years. These are some of the reasons she cannot rent from us, buy her own home or stay where she is, she has no resources to do so. What savings she has is being used up in her day to day expenses. To help her out as well as provide a place for us to stay, we are looking at buying a house. This should lower her monthly costs and help her to stay somewhat independent. Soon enough we will have to address doing more for her.

Can I buy a home and not belong to a home owners association?

I live in an area where home owners associations are rampant. My wife and I would prefer not to belong to an association but most homes unfortunately have one. Other than looking for older lots that aren’t subject to an association, is there any way to buy a home and not belong? I don’t really like the idea of not being able to do certain activities without permission (i.e. working on my vehicle, parking a truck in the driveway, using a limited set of colors, restricted fence types, etc…). I’m not looking to do anything crazy (I’m actually fairly conservative), I just don’t want some arbitrary association telling me what I can and can’t do.

tassie - My wife and I have always wanted to visit Australia. Maybe my company will transfer me there (they are going after more international work lately).
Babs - I’m not looking for a gated community. I’m merely looking for a single family home that is on a less traveled road (i.e. not along a major thruway). Most of the homes have clauses that once they are in an association they can not be sold without restricting to be a member. I’m trying to find a way that I can legally purchase the home and not be a member in a home owner association. I am not looking to have any of the services provided by the association (lawn care, pool, etc…). If I wanted any of them, I’d pay for lawn care or join a club. I don’t want it associated with my home. I also don’t want to be told what I can and can’t do with the house (probably the more important aspect of the question).
